SECTION 3 - LEGAL PROTECTION
Definitions for Legal Protection
Lawyer
The Lawyer or other suitably-qualified person appointed to act for You under condition 2 under the section headed Conditions applying to legal protection only.
Legal Costs
All reasonable and necessary costs charged by the Lawyer up to the standard basis. Also the costs Your opponents have run up if You have to pay them, or pay them with Our agreement.
Territorial Limit
England, Scotland, Wales and Northern Ireland.
Occurrence
The date of the event which may lead to a claim. If there is more than one event arising at the same time or from the same cause, then the Occurrence is the date of the first of these events.

We will negotiate for the following
- Your legal rights to recover any rent Your tenant owes You for the Buildings
- Your legal rights to evict anyone, other than tenants who do not have Your permission to be in the Building
- To defend Your legal rights if an event arising from You letting the Buildings leads to You being prosecuted in a criminal court

- Any claim reported to Us more than 90 days after the date You should have known about the Occurrence
- Any Legal Costs that You pay or agree to pay before We have agreed to pay them
- Any disagreement with Your tenant when the Occurrence is within the fist 90 days of the first period of insurance and the tenancy agreement started before the commencement of this cover.
- Any claim relating to registering rent, reviewing rents, buying the freehold of the Buildings or any matter which relates to rent tribunals, land tribunals or rent assessment committees unless You are defending an action brought against You by Your tenant.
- Any claim to do with someone legally taking the Buildings from You whether You are offered Money or not, or restrictions or controls placed on the Buildings by any government or public or local authority.
- Any claim relating to any work done by any government or public or local authority.
- Applications for judicial reviews.
- Any fines, damages or other penalties, which You are ordered to pay by a court or other authority.
- Any disagreement with Us.
- Any legal action You take which We or the Lawyer have not agreed to or where You do anything that hinders Us or the Lawyer.

SETTLING CLAIMS FOR LEGAL PROTECTION
We will provide the cover in this section as long as:
- the Occurrence happens during the period of insurance and within the Territorial Limit
- any legal proceedings will be dealt with by a court or other body which We agree to and
- in civil claims it is always more likely than not that Your claim or defence will succeed
For all insured events We will help in making or defending an appeal.
The maximum We will pay for all claims resulting from one or more events arising at the same time or from the same cause is £25,000.
CONDITIONS APPLYING TO LEGAL PROTECTION ONLY
- You must do the following
- Take reasonable steps to keep any amount We have to pay as low as possible.
- Try to prevent anything happening that may cause a claim.
- Send Us and the Lawyer everything that We ask for in writing.
- Give Us full details in writing of any claim as soon as possible and give Us any information that We need.

- We can take over and conduct in Your name any claim or legal proceedings at any time before a Lawyer is appointed.
- We can negotiate any claim on Your Behalf.
- If We agree to start legal proceedings or if there is a conflict of interest You can choose a Lawyer by sending Us the Lawyers name and address. We may choose not to accept the choice of Lawyer but only in exceptional circumstances. If there is a disagreement over the the choice of Lawyer another Lawyer can be appointed subject to conditions 7 and 8 of this section of Your policy.
- Before You choose a Lawyer We can appoint a Lawyer.
- We will appoint a Lawyer according to Our standard terms of appointment and the Lawyer must co-operate fully with Us at all times.
- We will have direct contact with the Lawyer at all times.
- You must co-operate fully with Us and with the Lawyer and must keep Us up to date with the progress of the claim.
- You must give the Lawyer any instructions that We ask for.

- You must tell Us if anyone offers to settle any claim.
- If You do not accept a reasonable offer to settle a claim We may refuse to pay further Legal Costs.
- You must not negotiate or agree to settle a claim without Our consent and approval.
- We may decide to pay You the amount of damages that You are claiming or is being claimed against You instead of starting or continuing proceedings.

- If We ask You must instruct the Lawyer to have the bill for Legal Costs taxed, assessed or audited.
- You must take every step to recover Legal Costs that We have to pay and must pay Us any legal costs that are recovered.
- If a Lawyer refuses to continue acting for You or if You dismiss a Lawyer the cover We provide will end at once unless We agree to appoint another Lawyer.
- If You stop a claim without Our agreement or do not give suitable instructions to the Lawyer the cover We are providing will end at once.
- If We cannot agree with You about the choice of Lawyer or about the handling of a claim You and We can agree in writing to choose a Lawyer to decide the matter in dispute.
- If We cannot agree with You about Your choice of the second Lawyer We will ask the President of the Law Society to choose a Lawyer. Whoever loses the disagreement will have to pay the costs of settling it.
- We will not pay any claim covered under any other policy or any claim that would have been covered by any other policy if this section of this policy did not exist.
MAKING A CLAIM - this procedure applies to the Legal Protection Cover Section only
Your policy provides You with 2 invaluable assistance services that operate 24 hours a day, 7 days a week.
Legal Advice
You can obtain legal advice on any personal legal matter. The advice is provided by a team of lawyers who can assist and advise You quickly and expertly over the telephone. All advice given is completely confidential and if requested or if the lawyer thinks is appropriate can be confirmed in writing.
Domestic Property Service
If Your property has a domestic emergency such as a burst pipe, blocked drain, broken window or damage to the Building You can arrange for a contractor to come and help You simply by making a single telephone call.
You will be responsible for all call out and repair costs but these may be claimed back in certain circumstances if You have Buildings insurance under Your policy.
Please note this service is for emergencies and is not a maintenance service.
To use either of these 24 hours a day, 7 days a week services simply call 01455 251500 You will then be asked to provide a scheme number, which is 70697 and the assistance You require will be provided.
